Filing 8 ORDER Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $8.47 from Plaintiff's account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk is directed to send a copy of this order (electronically if possible) to the trust fund supervisor at the Pinckneyville Correctional Center and the Court's fiscal department. Plaintiff may proceed with a due process claim against Officers Gomez and Moreno and Detective Hyon, although the defendants may ask the Court to stay this action pending completion of Plaintiff's state court criminal proceedings. The Court directs the Clerk to: (1) issue summonses for service on Officers Gomez and Moreno and Detective Hyon; (2) correct the caption to reflect that Officer Gomez is the lead defendant and correct the docket to reflect that the Chicago Police Department is no longer an active defendant; and (3) send Plaintiff three blank USM-285 service forms, a magistrate judge consent form, filing instructions, and a copy of this order. Plaintiff must return completed USM-285 service form for Officers Gomez and Moreno and Detective Hyon to the Clerk in care of the Prisoner Correspondent by October 6, 2020. If he fails do so, the Court may dismiss any unserved defendants and dismiss this case for lack of prosecution. The Marshal is appointed to effect service and is authorized to send requests for waiver of service in the manner prescribed by Fed. R. Civ. P. 4(d). Given the current public health crisis, the Court does not expect the Marshals Service to obtain personal service at this time, although requesting a waiver is still permitted if feasible. Plaintiff's request for attorney representation #4 is denied without prejudice as nothing is required from him at this time other than returning the service forms, given that Court staff will monitor service. Plaintiff must promptly submit a change-of-address notice if he is released or transferred to another facility. If he fails to comply, this case will be subject to dismissal with no further warning.
