ORDER: This matter is before the Court on Plaintiff's motion #6 to waive filing fees pursuant to 38 U.S.C. 4323(h)(1). Plaintiff's motion #6 is granted and the filing fee is waived. Plaintiff brings suit for alleged violations of USERRA and therefore is not required to prepay fees or court costs. See 38 U.S.C. 4323(h)(1); Davis v. Advocate Health Center Patient Care Exp., 523 F.3d 681, 684-85 (7th Cir. 2008) (veteran's filing fees to prepay for suit against former employer who allegedly violated USERRA were "fees and costs," within meaning of USERRA's waiver of any fees or court costs incurred in bringing suit for discrimination against persons on ground of their service in uniformed services).
