EMAILED order dated 9/24/2020, #11 to Metropolitan Correctional Center (MCC) Trust Fund Officer and court's fiscal department. (ph, ) |
Filing 11 ORDER: The Court grants Plaintiff's renewed application to proceed in forma pauperis #8 #10 . The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $31.33 from Plaintiff's account for payment to the Clerk of Court as an initial partial filing fee in this case. As discussed below, the Court also orders Plaintiff to pay (and the facility having custody of her to automatically collect and remit) to the Clerk of Court, 40% of any and all deposits to Plaintiff's account until her filing fees have been paid in full. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at the facility having custody of Plaintiff and to this court's fiscal department. Plaintiff's complaint #1 , however, is dismissed as frivolous. This dismissal counts as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g) but is without prejudice to Plaintiff pursuing claims stemming from her arrest and the search of her home in Salley v. McChrystal, No. 20 C 4188 (N.D. Ill.). The Court directs the Clerk of Court to enter final judgment. This case is closed. Signed by the Honorable Robert W. Gettleman on September 24, 2020. Filing 6 ORDER: The Court denies Plaintiff's application for leave to proceed in forma pauperis #3 without prejudice. If Plaintiff wants to proceed to screening under 28 U.S.C. 1915A, he must either (1) prepay the full statutory filing fee of $400.00; or (2) submit a renewed application to proceed in forma pauperis that complies with the instructions in the statement section of this order. Failure to comply by September 17, 2020, will result in summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this case for failure to comply with a Court order and for want of prosecution. The Court defers initial review of Plaintiff's complaint until his fee status has been resolved. The Court directs the Clerk of Court to (1) revise the docket to reflect the correct spelling of Plaintiff's name, "Awanata v. Kameros et al," and (2) send Plaintiff a blank application to proceed in forma pauperis along with a copy of this order. Signed by the Honorable Robert W. Gettleman on August 13, 2020.
