| Filing 19 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's counsel is directed to provide to defendants' counsel by 9/8/2020, pursuant to an appropriate designation under the applicable protective order, the unredacted copies of Sharon Bradford's medical records that were provided to the Court for in camera inspection. The Court grants plaintiff's motion to quash the subpoena for a deposition by oral questions that was served upon Ms. Bradford. Given Ms. Bradford's medical condition as documented in her medical records, a deposition by oral questions is not only against the advice of her treating physician but is highly unlikely to be productive. If they wish, defendants may take the deposition of Ms. Bradford by written questions pursuant to Fed. R. Civ. P. 31, and both sides are directed to work together to make that happen. The Court expresses no view at this time regarding the admissibility of Ms. Bradford's testimony at trial or for any other purpose. (mk) |
