Filing 29 MINUTE entry before the Honorable John F. Kness: Before the Court is a "Stipulation Regarding Consolidation" filed in cases 20-cv-05262 (Dkt. 20 )and 20-cv-05295 (Dkt. #27 ). Construing the stipulation as a motion asking for the Court to consolidate these two cases, the motion is granted. Cases 20-cv-05262 and 20-cv-05295 are consolidated under docket 20-cv-05262 in accordance with Rule 42(a) of the Federal Rules of Civil Procedure. Case 20-cv-05262 shall be referred to as the "Consolidated Action." All papers filed in the Consolidated Action must be filed under case No. 20-cv-05262 (as the first number assigned to the first-filed case). The case file for the Consolidated Action will be maintained under what the parties have designated as "Master File No. 1:20-cv-05262." In the Stipulation, the parties suggest that "[t]he Clerk will be directed to administratively close the following related case: Rancho's Club Casino, Inc. v. Scientific Games Corp. et al., Case No. 1:20-cv-05295." Although the precise relief sought is unclear (a dismissal is required before a case can be closed), the Court will effect the apparent intent of the parties by dismissing case 20-cv-05295 without prejudice and directing the Clerk to terminate the case from the docket. If the Court has misconstrued the parties' intent, they are feel to file an appropriate motion for relief. As set forth in the Stipulation, Plaintiffs will file a Consolidated Complaint in case 20-cv-05262 no later than five days after the date of the entry of this order on the docket. Finally, according to the parties' Stipulation, Defendants' anticipated motion to dismiss and brief in support is due on or before November 9, 2020; Plaintiffs' response in opposition is due on or before December 7, 2020; and Defendants' reply (if any) is due on or before December 21, 2020. This briefing schedule is based on what the parties requested on October 16. If the briefing schedule needs to be revised based on the roughly two-week interval between that proposal and the entry of this order, the parties are free to propose an amended schedule by email to proposed_order_kness@ilnd.uscourts.gov. Plaintiff has filed objections to the motion #20 . A district court has discretion to extend a deadline for "good cause." Fed. R. Civ. P. 6(b)(1). Defendants argue that an extension is warranted because they are continuing their investigation of Plaintiff's claims and of their potential defenses. Dkt. 15 at 3. Defendants also note that the COVID-19 pandemic has delayed such investigation. Id. Plaintiff argues that an extension will cause it prejudice because it also has "business considerations affected by litigation and Covid-19." Dkt. 20 at 5. While the Court is mindful of the disruption that the current health crisis has caused for both parties, the Court finds that the circumstances described in Defendants' motion adequately demonstrate good cause to allow such an extension under Rule 6(b)(1). Accordingly, Defendants' motion is granted. Defendants shall answer or otherwise respond to the complaint on or before November 9, 2020.
