Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court waives the initial partial filing fee but authorizes and orders the trust fund officer at Plaintiff's place of incarceration to begin making monthly deductions in accordance with this order for payment to the Clerk of Court toward the $350.00 statutory filing fee. Plaintiff's trust fund officer must collect 100% of all income into his trust account until accrued filing fees are paid. The Court directs the Clerk to send copies of this order to the Court's Fiscal Department, and to the trust account office at Plaintiff's place of confinement. Summonses shall not issue at this time, however. The Court grants Plaintiff's motion for attorney representation #4 and requests that Heather Lewis Donnell / Loevy & Loevy / 311 N. Aberdeen Street, 3rd FL / Chicago, Illinois 60607 / 312-243-5900 / heather@loevy.com represent Plaintiff in accordance with counsel's trial bar commitment under Local Rule 83.37 (N.D. Ill.). The complaint on file is dismissed without prejudice to Plaintiff's counsel filing an amended complaint by December 1, 2020, assuming counsel can do so consistent with her obligations under Rule 11 of the Federal Rules of Civil Procedure. Plaintiff's motion for service of process at government expense #5 is denied as premature. Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States; therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above- captioned case, as well as for Case Nos. 15 CV 50277 (N.D. Ill.), 18 CV 50381 (N.D. Ill.), 20 CV 5341 (N.D. Ill.), 20 CV 5342 (N.D. Ill.), 20 CV 5343 (N.D. Ill.), 20 CV 5344 (N.D. Ill.), 20 CV 5345 (N.D. Ill.), 20 CV 5346 (N.D. Ill.), 20 CV 5347 (N.D. Ill.), 20 CV 5349 (N.D. Ill.), 20 CV 5350 (N.D. Ill.), 20 CV 5351 (N.D. Ill.), 20 CV 5355 (N.D. Ill.), 20 CV 5361 (N.D. Ill.), 20 CV 5370 N.D. Ill.), 20 CV 5371 (N.D. Ill.), 20 CV 5373 (N.D. Ill.), 20 CV 5382 (N.D. Ill.), and 20 CV 5383 (N.D. Ill.). The Court instructs recruited counsel to open a separate PACER account to be used only for the above-captioned cases, and fees are exempt for these cases only. Counsel shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of counsel's participation in the matter. This exemption may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver.
