Date Filed Document Text
November 19, 2020 Opinion or Order Filing 15 MINUTE entry before the Honorable Heather K. McShain: The Court has reviewed Defendant's Unopposed Motion for Extension of Time to File the Electronic Certified Administrative Record and Answer to Plaintiff's Complaint #14 . Defendant states that the ongoing COVID-19 pandemic has significantly impacted operations in the Social Security Administration's Office of Appellate Operations (OAO) in Falls Church, Virginia, which is the office responsible for physically producing the administrative record that is required to adjudicate the case. Defendant cites teleworking restrictions, efforts to redesign OAO's business processes to allow for mostly virtual certified administrative record preparation, and a resulting backlog of certified administrative records. In light of these issues, the Court finds that there is good cause for Defendant's requested extension. Defendant's motion #14 is granted. Defendant has until 01/22/2021 to either (1) file the electronic certified administrative record and answer Plaintiff's complaint; or (2) file a status report to update the Court on the status of the administrative record. Mailed notice. (pk, )

The Social Security Administration's motion to affirm the decision subject to review and its brief in support are due 45 days after plaintiff's brief is filed. Plaintiff's reply brief, if any, is due 14 days after defendant's brief is filed. No oversized briefs will be allowed without prior court approval obtained at least one week before the due date and upon good cause shown. Mailed notice. (pk, )

See also Manning v. Arizona, No. 12 C 1019, 2012 WL 1161506, at *1 (N.D. Ill. Apr. 9, 2012).
