October 30, 2020 Opinion or Order Filing 7 ORDER: On October 15, 2020, the Court denied Plaintiff's application for leave to proceed in forma pauperis and ordered him to prepay the filing fee by November 16, 2020. #5 Plaintiff now moves for "the maximum extension possible" to comply, asserting that he had "depleted [his] trust fund account prior to initiating [this] lawsuit because [he] was promised funds from a family member who no longer can fulfill [the] promise." #6 Plaintiff's motion #6 is taken under advisement. By November 30, 2020, Plaintiff must submit a trust fund account statement covering September 15, 2020, through the date of his response, which the Court will examine to resolve Plaintiff's motion. He may also submit a written explanation of his purchases if desired. Plaintiff should be aware that if trust fund records show that he has been prioritizing other purchases over the filing fee (in other words, if he has continued to spend money, with which he could have paid the fee, on other items) the Court may not excuse his failure to pay the filing by the original deadline. As the Court already explained, Plaintiff's decision to place the filing fee for this action at the bottom of his list of priorities demonstrates "an implied evaluation of [his] suit that the courts should be entitled to honor." Merritte v. Templeton, 493 Fed. App'x 782, 784-85 (7th Cir. 2012) (quoting Roller v. Gunn, 107 F.3d 227, 233 (4th Cir.1997)); Lucien v. DeTella, 141 F.3d 773, 774-75 (7th Cir. 1998) ("Lucien thought clothing and sundries more valuable than continued pursuit of litigation. That is his choice; he must accept the consequences."). If Plaintiff fails to comply with this order by the date set forth above, the Court will summarily dismiss this lawsuit. Signed by the Honorable Sharon Johnson Coleman on 10/30/2020. Mailed notice.
