Filing 5 MINUTE entry before the Honorable John J. Tharp, Jr: Plaintiff 1823 Wise LLC is directed to file, by 10/21/20, an amended complaint setting forth an adequate factual basis for their assertion of jurisdiction under 28 U.S.C. 1332. The complaint does not include sufficient information in support of the amount in controversy. Under 28 U.S.C. 1332, the amount in controversy must exceed $75,000. Other than a claim for $60,000 and 60% of the amount Plaintiff seeks to recover under the Policies, the complaint alleges no basis to infer the amount in controversy, such as, for example, the policy amounts. Further, the complaint fails adequately to allege diversity. Specifically, the citizenship of an LLC is that of its members (i.e., owners), not its officers (who may or may not be members), and its principal place of business is not relevant to the jurisdictional analysis.
