Filing 15 MINUTE entry before the Honorable Heather K. McShain: This case has been referred to Magistrate Judge McShain for discovery scheduling and supervision, including the authority to conduct any settlement conference as appropriate #14 . On review of the parties' status reports [10, 11], as well as the parties' Rule 26(f) Report #12 , the Court enters the following agreed discovery schedule: first set of written discovery to be issued by 01/26/2021; fact discovery to be completed by 12/22/2021. The Court notes that this case is not subject to the Mandatory Initial Discovery Pilot Project, which expired on 06/01/2020, so no such disclosures are required. The parties shall exchange Rule 26(a)(1) disclosures on or before 01/12/2021. Additionally, the Court notes that the parties have proposed deadlines for amendment to the pleadings and dispositive motions. Because setting these deadlines exceeds the scope of the District Judge's referral of this case to the undersigned, the parties are directed to bring these proposed dates to the District Judge. Joint status report due 02/22/2021 to update the Court on: (a) the progress of discovery; (b) each party's proposed dates for the disclosure of expert reports and completion of expert depositions, including, if desired, a succinct explanation as to the reasoning for each party's proposed dates; (c) the status of settlement discussions, if any; and (d) any other issues the parties believe should be brought to the Court's attention. The parties should be mindful that, notwithstanding any preference to take depositions in person, they cannot expect this in the current environment, nor can they reasonably expect the case to be put on hold until that changes. To be more specific, the parties are to assume that all depositions will have to be taken by remote means (unless both sides and the witness consent to an in-person deposition) and are to plan accordingly. Delay due to a desire to take in-person depositions at a later date will not be a basis for extending any discovery deadline beyond the current deadline.
