MINUTE entry before the Honorable Edmond E. Chang: Telephonic status hearing held with the Interim Steering Committee, Plaintiff's Liaison Counsel, and Defense Lead Counsel. As discussed during the hearing, the defense emailed the Ciao Baby page citations. (1.) On consideration of the operative complaints, briefs, and pertinent issues, the bellwether motions are: Big Onion, 20-cv-2005; Valley Lodge, 20-cv-2813; and Rising Dough, 20-cv-5981. Although the Court appreciates the defense position, neither Billy Goat, 20-cv-2068, nor Ciao Baby, 20-cv-3251, present materially different arguments or settings that would warrant consideration as a bellwether motion. It also is in the interest of speedy deliberation to minimize the number of bellwether motions. (2.) With regard to supplemental authority, by 11/09/2020, the parties may file simultaneous omnibus responses to the currently cited supplemental authority. Omnibus cross-replies due by 11/13/2020. As discussed during the hearing, the 15-page limit on briefs shall be enforced and the Court will not surprise either side with significant reliance on supplemental authority. (3.) Discovery is stayed until further order of the Court, including the reinsurance and financial-information disclosures proposed by the Interim Steering Committee. Having said that, if the defense bellwether motions are denied, then the Court will set a speedy schedule going forward, including pursuing the litigation and mediation track simultaneously. (4.) The stay on other cases remains in place, with the caveat that parties in a particular case may move for limited relief from the stay for limited purposes if necessary. (5.) Telephonic status hearing set for 12/02/2020 at 9:30 a.m. If oral argument is needed, then the Court will give the lawyers at least one-week advance notice and will flag the specific issues.
