Tharp, Jr on 12/7/2020: By order dated October 26, 2020 #10 , the Court directed Plaintiff to pay the full statutoryfiling fee of $400, and advised him that failure to comply by November 23, 2020, would result in summary dismissal of this case Plaintiff had previously been ordered to pay by November 20,2020, and failed to do so #6 . As of today's date, Plaintiff has not addressed his fee status, and the Court has not heard from Plaintiff since entry of the October 26, 2020, order. Accordingly, thisaction is dismissed without prejudice pursuant to Fed. R. Civ. P. 41(b). See Fed. Election Comm'n v. Al Salvi for Senate Comm., 205 F.3d 1015, 1018 (7th Cir. 2000) (court has authority both inherently and under Rule 41(b) to dismiss case as sanction for failure to prosecute and noncompliance with court order). Having brought this action, Plaintiff remains obligated to pay the filing fee. See 28 U.S.C. 1915(b)(1). The Court directs the Clerk to enter a final judgmentof dismissal. This case is closed. October 26, 2020 Opinion or Order Filing 10 ORDER :Plaintiff's motion for reconsideration #7 is denied as unnecessary. Plaintiff is seeking tobe excused from providing the financial information ordered by the Court on October 15, 2020 #6 . The financial information provided by Plaintiff in his renewed motion to proceed in formapauperis #8 is sufficient for the Court to determine Plaintiff's financial status. Plaintiff's renewed application for leave to proceed in forma pauperis #8 is denied. If Plaintiff wants to proceed with this lawsuit, he must pay the $400 filing fee. If Plaintiff does not comply by November 23, 2020, this case will be summarily dismissed. If Plaintiff wants to proceed with this lawsuit, he must either (1) submit a renewed application that is certified by an appropriate official and accompanied by a copy of Plaintiff's trust fund statement showing all transactions in his account for the six-month period immediately preceding his initiation of this action (4/13/20 through 10/13/20); or (2) pay the full statutory filing fee of $400.00. Failure to comply with this order by November 20, will result in summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released.
