Filing 8 ORDER Signed by the Honorable Andrea R. Wood on 12/7/2020: Plaintiff's motion for leave to proceed in forma pauperis #3 is granted. The Court authorizes and orders the trust fund officer at Plaintiff's place of incarceration to deduct $18.50 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this Order. Plaintiff's trust fund officer must collect 100% of all income into his trust account until accrued filing fees are paid. The Court directs the Clerk to forward copies of this Order to the Fiscal Department and to the trust account office at Plaintiff's place of confinement. However, summonses shall not issue at this time. The Court grants Plaintiff's motion for attorney representation #4 and requests that Drew George Peel / Rachlis Duff & Peel, LLC / 542 South Dearborn Street, Suite 900 / Chicago, Illinois 60605 / 312-733-3950 / dpeel@rdaplaw.net represent Plaintiff in accordance with counsel's trial bar commitment under Local Rule 83.37 (N.D. Ill.). The complaint on file is dismissed without prejudice to Plaintiff's counsel filing an amended complaint by 2/1/2021, assuming counsel can do so consistent with his obligations under Rule 11 of the Federal Rules of Civil Procedure. The Court advises Plaintiff that because he is now represented by counsel, he may not send any pro se motions, pleadings, or other submissions to the Court, the Clerk of Court, the Prisoner Correspondent, Defendants, or defense counsel. Only Plaintiff's counsel may file documents on his behalf under this case number. To check on the status of the anticipated amended complaint, the Court sets a telephonic status hearing for 1/14/2021 at 10:15 AM. To ensure public access to court proceedings, members of the public and media may call in to listen to telephonic hearings. The call-in number is (888) 557-8511 and the access code is 3547847. Counsel of record will receive an email 30 minutes prior to the start of the telephonic hearing with instructions to join the call. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court-issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court.Recruited counsel falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States; therefore, counsel shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case and for Case Nos. 16 CV 7068 (N.D. Ill.); 17 CV 9368 (N.D. Ill.), 19 CV 3869 (N.D. Ill.), 19 CV 3873 (N.D. Ill.), 19 CV 4083 (N.D. Ill.), and 19 CV 4086 (N.D. Ill.). The Court instructs recruited counsel to open a separate PACER account to be used only for the above-captioned cases, and fees are exempt for these cases only. He shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of counsel's participation in the matter. This exemption may be revoked at the discretion of the Court at any time. Counsel shall contact the PACER Service Center at 1-800-676 6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver.
