ORDER: Plaintiff Anthony F. Mayer, a Cook County Jail detainee, brings this pro se civil lawsuit against an attorney who previously represented him in his pending criminal case. Before the Court are Plaintiff's application for leave to proceed in forma pauperis, complaint for initial review, and motion for attorney representation. Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $7.65 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send (electronically if possible) a copy of this order to the trust fund officer at Plaintiff's current place of incarceration and to the Court's Fiscal Department. However, summons shall not issue. Plaintiff's complaint #1 is dismissed with prejudice as to any intended claim under 42 U.S.C. 1983 but without prejudice to Plaintiff pursuing his claims in state court or seeking relief through a direct criminal appeal or in a postconviction petition. This dismissal shall count as a dismissal under 28 U.S.C. 1915(g). Plaintiff's motion for attorney representation #4 is denied. Signed by the Honorable Franklin U. Valderrama on 11/9/2020.
