Filing 7 MINUTE entry before the Honorable Mary M. Rowland: On or before 12/18/20, the parties shall file a joint initial status report. A template for the Initial Status Report, setting forth the information required, may be found at http://www.ilnd.uscourts.gov/Judges.aspx by clicking on Judge Rowland's name and then again on the link entitled 'Initial Status Conference.' (dm, ) |
Filing 6 MINUTE entry before the Honorable Mary M. Rowland: Plaintiff alleges jurisdiction based on diversity of citizenship in this case (Dkt. 1). Plaintiff states that it is a Michigan limited liability company, but it does not identify its members or their citizenships. Plaintiff identifies the member of Defendant Chestnut LLC, but does not provide the membership of Hotel Capital, LLC. The same is true for Defendant Tremont LLC. Therefore on or before 11/20/20, Plaintiff shall file a jurisdictional supplement, as a separate docket entry. Plaintiff is reminded that for LLCs, the citizenship is the citizenship of each of its members. Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Thus "an LLC's jurisdictional statement must identify the citizenship of each of its members as of the date the complaint or notice of removal was filed, and, if those members have members, the citizenship of those members as well." Id. If Plaintiff fails to file the jurisdictional supplement as directed, the case may be dismissed for lack of subject-matter jurisdiction. Mailed notice. (dm, ) |
