Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $31.70 from Plaintiff's account for payment to the Clerk of Court as an initial partial filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at Plaintiff's place of incarceration and to this court's fiscal department. Summons shall not issue, however. The Court dismisses Plaintiff's complaint #1 without prejudice for failure to state a claim upon which relief can be granted. If he seeks to proceed, Plaintiff must, by February 5, 2021, submit an amended complaint, or the Court will dismiss Plaintiff's lawsuit with prejudice for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action may be subject to dismissal for failure to comply with a court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 is denied without prejudice. The Clerk is directed to send Plaintiff an amended civil rights complaint form and a copy of this order.
