MAILED a blank amended complaint form and a copy of order dated 12/15/2020 to plaintiff (rp, ) |
Filing 8 ORDER: By order of Nov. 6, 2020, the Court dismissed Plaintiff's complaint without prejudice for failure to state a federal claim #6 . Plaintiff was warned that failure to submit a proposed amended complaint by Dec. 11, 2020, would result in dismissal of this case. Plaintiff has not submitted an amended complaint, but has submitted an "add on" that reiterates that he is attempting to sue the City of Chicago and five officers for malicious prosecution and false imprisonment #7 . Plaintiff cannot amend his complaint in a piecemeal fashion, so the "add-on" is stricken. See Kitterman v. Director, No. 16-cv-00014, 2017 WL 2876533, at *1 (S.D. Ill. July 6, 2017) (Yandle, J.) (claim must be set forth in a single pleading that specifies by name each defendant alleged to be liable and the actions that each defendant allegedly took in violation of the plaintiff's rights); see also Flannery v. Recording Indust. Ass'n of Am., 354 F.3d 632, 638 n.1 (7th Cir. 2014) (amended complaint supersedes the prior complaint and renders it void). If Plaintiff wants to proceed with this case, he must submit a complete amended complaint that stands on its own and addresses the defects identified in the Court's Nov. 6, 2020 order. The Court extends the deadline to do so to January 12, 2021. Failure to submit a proposed amended complaint by that date will result in summary dismissal of this case. The Clerk is directed to mail Plaintiff a blank amended complaint form and a copy of this order. Signed by the Honorable Robert W. Gettleman on 12/15/2020. Mailed notice (cn). |
Filing 7 ADD ON to case number 1.20-cv-6392 filed by Forrest Dix. (Envelope Postmarked 12/1/2020) (jh, ) |
EMAILED Order dated 11/06/2020 #6 to Supervisor of the Inmate Trust Fund Accounts at Cook County Jail. (daj, ) |
Filing 6 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $29.20 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. However, summons shall not issue at this time. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a federal claim upon which relief can be granted. Failure to submit a proposed amended complaint by December 11, 2020 will result in dismissal of this case for failure to state a claim. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 is denied without prejudice. (daj, ) Modified on 11/9/2020 (rp, ). |
