November 5, 2020 Filing 7 MINUTE entry before the Honorable Manish S. Shah: Plaintiff's application to proceed in forma pauperis #3 is entered and continued. The plaintiff's complaint is dismissed without prejudice for lack of subject-matter jurisdiction. The complaint appears to bring a medical malpractice claim against Ingalls Hospital (which is also known as UChicago Medicine Ingalls Memorial Hospital). That kind of claim can be brought in federal court only if the plaintiff and the defendant are citizens of different states and the amount in controversy is over $75,000. Plaintiff checked the box for diversity jurisdiction on the civil cover sheet, but the complaint does not allege the citizenship of the parties. If plaintiff can file an amended complaint that properly alleges diversity jurisdiction, the court will consider her application to proceed in forma pauperis. Any amended complaint must be filed by 11/19/20. If no amended complaint is filed, this case will be closed without prejudice to plaintiff filing suit in state court.
