Filing 44 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff's motion for entry of a preliminary injunction #35 is granted. Plaintiff's attorney has not submitted a draft preliminary injunction order to Judge Kennelly's web page. As a result the Court cannot enter a preliminary injunction order at this time. The preliminary injunction / status hearing set for 1/5/2021 is vacated. The case is set for a status hearing on 3/4/2021 at 8:45 AM. The following call-in number will be used for the hearing: 888-684-8852 / conference code 746-1053. Counsel should wait for the case to be called before announcing themselves. A status report regarding service of process and settlement discussions is to be filed by 2/25/2021. Plaintiff's attorney is reminded that the notice of motion rule was suspended by the District months ago; as a result motions are to be simply be filed and not noticed up for hearing. In addition Judge Kennelly's webpage states that when a motion is filed that requires entry of a long-form order such as a preliminary injunction counsel is to submit that order at the time of filing the motion. The Clerk is directed to unseal all documents that were previously filed under seal. Plaintiff has now moved for entry of a preliminary injunction and asks that this order likewise be entered ex parte and under seal. The sealing of a preliminary injunction in these circumstance's would be unusual, to say the least, and it is certainly not the norm in cases of this type--a lawsuit against Internet sellers of alleged counterfeit products. Plaintiff's moving papers do not make any attempt to justify entry of a preliminary injunction ex parte and under seal. Unless plaintiff can show this, the Court is inclined to decline the request. Plaintiff should be prepared to address that at the 12/14/2020 hearing but should also submit in advance of that hearing whatever further factual and legal justification for entry of an ex parte sealed preliminary injunction that plaintiff can muster.
