January 4, 2021 Filing 26 NOTICE of Voluntary Dismissal by KTM AG Plaintiff's Notice of Voluntary Dismissal Without Prejudice of All Remaining Defendants (Hierl, Michael)
December 16, 2020 Filing 25 MINUTE entry before the Honorable Steven C. Seeger: In connection with the motion for a temporary restraining order, the Court received a Word version of a proposed order. It appears to be a draft that plaintiff's counsel uses in many other Schedule A cases, except for information about the individual Plaintiff. The draft posed a number of formatting challenges, and required significant time and attention by the Court. (The indentations, tabs, and paragraph numbering were particularly problematic.) The Court also made a number of substantive changes to the draft temporary restraining order. A redline is attached. Going forward, in any future Schedule A case filed before Judge Seeger, plaintiff's counsel must submit a draft that is free of issues and that incorporates the considerable changes that this Court made in the case at hand. Continuing to use the generic draft that the Court received, and simply plugging in the names of new clients in future Schedule A changes, is not a viable option. A failure to comply with this Order may lead to denial of the motions, and/or may delay any relief from this Court. Mailed notice (jjr, ) (Additional attachment(s) added on 12/16/2020: #1 Proposed TRO (Redline)) (jjr, ). Modified on 12/29/2020 (jjr, ).
December 16, 2020 Filing 24 SEALED TEMPORARY Restraining Order Signed by the Honorable Steven C. Seeger on 12/16/2020. Mailed notice. (jjr, )
December 16, 2020 Filing 23 MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's ex parte motion for temporary restraining order (Dckt. No. #8 ) is hereby granted in part. Order to follow. At this point, the Court declines to order the transfer or disabling of the Defendant domain names. The Court denies that request without prejudice. Plaintiff can try again if it so chooses, but must make a more fulsome showing that such relief is warranted. Plaintiff's motion for excess pages (Dckt. No. #7 ) is hereby granted. Plaintiff's motion to seal (Dckt. No. #5 ) is hereby granted. Mailed notice. (jjr, )
