December 2, 2020 Opinion or Order Filing 4 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $30.50 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Summonses, however, will not yet issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim. If he seeks to proceed, Plaintiff must, by January 6, 2021, submit: (1) an amended complaint on the Court's required form; and (2) a completed USM-285 (Marshals Service) form for each Defendant named in the amended complaint. If he fails to comply, this case will be dismissed. The Clerk of Court is directed to send (electronically if possible) a copy of this order to the trust fund officer at the facility currently having custody of Plaintiff and to Plaintiff, who shall also receive a civil rights amended complaint form and one USM-285 service form (of which he may make copies if needed).
