December 16, 2020 Opinion or Order Filing 6 ORDER Plaintiff Kersting's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff Kersting's place of incarceration to deduct $24.00 from Plaintiff Kersting's account for payment to the Clerk of Court as an initial partial filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at Plaintiff Kersting's place of incarceration and to this court's fiscal department. However, summons shall not issue. Plaintiff Kersting's complaint #1 is dismissed without prejudice for failure to state a claim upon which relief can be granted. If he seeks to proceed, by February 16, 2021, Plaintiff Kersting shall submit an amended complaint and a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint. If Plaintiff Kersting does not comply with this order, the Court will dismiss Plaintiff Kersting's lawsuit with prejudice for failure to state a claim. Plaintiff Kersting also must promptly submit a change-of- address notification if he is transferred to another facility or released. If Plaintiff Kersting fails to keep the Court informed of his address, this action may be subject to dismissal for failure to comply with a court order and for failure to prosecute. Plaintiff Kersting's motion for attorney representation #4 is denied without prejudice. The Clerk is directed to send Plaintiff Kersting an amended civil rights complaint form and instructions, a blank USM-285 form, and a copy of this order. Signed by the Honorable Elaine E. December 16, 2020 Opinion or Order Filing 5 ORDER Plaintiff Ian K. Clark is summarily dismissed with prejudice due to his failure to advise the Court that at least three of his previous cases have been dismissed on the grounds that they were frivolous, malicious, or failed to state a claim upon which relief may be granted. All pending motions submitted by Plaintiff Clark are terminated as moot. Having brought this action, Plaintiff Clark remains obligated to pay the full filing fee of $400. The Clerk is directed to send a copy of this order to the trust fund officer at Plaintiff Clark's place of incarceration and to the Court's fiscal department. Plaintiff Clark is again reminded that he must fully detail his litigation history in any future lawsuit, and he may not seek leave to proceed in forma pauperis unless he is under imminent danger of serious physical injury.
