Filing 8 ORDER: Plaintiff was directed to show cause by 12/18/2020 why this case should not be dismissed for lack of subject matter jurisdiction. #7 . Plaintiff has not responded. The court has an independent obligation to ensure that it has subject matter jurisdiction. Jason's Foods, Inc. v. Peter Eckrich & Sons, Inc., 768 F.2d 189, 190 (7th Cir. 1985). District courts have subject matter jurisdiction in cases (1) "arising under the Constitution, laws, or treaties of the United States," 28 U.S.C. 1331, or (2) "where the matter in controversy exceeds the sum or value of $75,000" and there is complete diversity of citizenship, 28 U.S.C. 1332(a). The court does not discern a basis for jurisdiction under either Section 1331 or Section 1332(a). First, as to Section 1331, the complaint does not contain any reference to a violation of a federal statute or constitutional provision by the defendants. Nor is any type of federal question otherwise apparent on the face of the complaint. Second, as to Section 1332(a), complete diversity of citizenship does not exist because the complaint expressly alleges that "[a]ll parties are citizens of Illinois." #1 5. Altom Transp., Inc. v. Westchester Fire Ins. Co., 823 F.3d 416, 420 (7th Cir. 2016) ("Section 1332 requires complete diversity: no plaintiff may be a citizen of the same state as any defendant."). However, on review of the complaint #1 , the court does not discern a basis for federal jurisdiction. the court will give plaintiff an opportunity to show cause by December 18, 2020, why the case should not be dismissed for lack of jurisdiction., i.e., plaintiff should submit a filing by December 18, 2020 identifying the basis for federal jurisdiction. Failure to do so (or to request an extension of time) by what date will lead to dismissal of this case for lack of jurisdiction. Plaintiff is free to file the complaint in state court at any time.
