December 18, 2020 Filing 28 MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's Motion for Reconsideration (Dckt. No. #22 ) is denied. Plaintiff asks the Court to rethink its ruling on the motion to proceed anonymously. "[T]his Court's opinions are not intended as mere first drafts, subject to revision and reconsideration at a litigant's pleasure." See Quaker Alloy Casting Co. v. Gulfco Indus., Inc., 123 F.R.D. 282, 288 (N.D. Ill. 1988). The motion was unnecessary. The motion for reconsideration begins by repeating what was "discussed in Plaintiff's original Motion." (Dckt. No. #22 ) The Court read "Plaintiff's original Motion," and then denied it. The urge to repeat oneself is not a reason to file a motion for reconsideration. A trademark case that alleges counterfeiting by sellers overseas, without more, is not an "exceptional circumstance" that warrants a departure from the duty of public disclosure under Rule 10(a). In other "Schedule A" cases, plaintiffs routinely disclose their identities, as they must under the Federal Rules. Also, this Court issued the temporary restraining order on December 16, but ordered Plaintiff to file an amended complaint and disclose its identity by December 22, 2020. That six-day period of additional anonymity is sufficient. By December 29, 2020, Plaintiff shall file a statement confirming whether it has frozen the accounts of the defendants. Plaintiff's (other) Motion for Reconsideration of the Terms of the Temporary Restraining Order and of Denial of Plaintiff's Motion to Proceed Anonymously (Dckt. #23 ) is granted in part and denied in part. (As an aside, footnote two states that Plaintiff "will be withdrawing" the first motion for reconsideration because it was "based on an inaccurate understanding of the terms of the TRO." But Plaintiff has not withdrawn it yet, so it is a live motion and the Court will rule on it.) Plaintiff notes that the temporary restraining order did not include an asset freeze. That argument is a good argument. An Amended Sealed Temporary Restraining Order to follow. The Court inadvertently deleted that provision when it deleted the provision about cutting off all advertising (which Plaintiff did not support, and which the Court does not grant). In light of the amended temporary restraining order, the Court extends the deadline to file an amended complaint to December 29, 2020. Plaintiff also requests a reduction in the amount of the bond because there are only six defendants. That request is granted. The Court hereby reduces the amount of the bond to $60,000. Given the scope of the requested relief, including freezing the funds of six entities on an expedited, ex parte basis, Plaintiff must internalize the risk of being wrong. Plaintiff argues that $10,000 is the standard bond in "Schedule A" cases in this District. But that argument begs the question of whether the standard practice is too lenient. Schedule A cases often involve freezing the funds of more than 100 entities, without any meaningful financial guarantee by the plaintiff in case there is a misfire. The Motion for Reconsideration of the Terms of the Temporary Restraining Order and of Denial of Plaintiff's Motion to Proceed Anonymously (Dckt. #23 ) is otherwise denied. The motion to seal (Dckt. No. #26 ) is granted. Docket Nos. 24 & 25 are sealed. Mailed notice. (jjr, )
