January 21, 2021 Opinion or Order Filing 10 ORDER: Plaintiff Kinton Jones, a prisoner at Menard Correction Center, brings this action pro se under 42 U.S.C. 1983. Before the Court is Plaintiff's amended complaint for screening as required by 28 U.S.C. 1915A. Plaintiff's amended complaint #8 is accepted. On its own motion, the Court terminates the John Doe Chicago Police Homicide Detective as a Defendant and substitutes Chicago Police Superintendent David Brown as a nominal Defendant. The Court directs the Clerk of Court to: (1) file Plaintiff's amended complaint #8 ; (2) terminate Defendants City of Chicago and County of Cook; (3) issue summons for service on Defendant Brown by the U.S. Marshal; and (4) send Plaintiff a blank USM-285 service form, a Magistrate Judge consent form, filing instructions, and a copy of this Order. The Court advises Plaintiff that a completed USM-285 form is required for service on Defendant Brown. The U.S. Marshal will not attempt service on Defendant Brown unless and until the required form is received. The U.S. Marshal is appointed to serve Defendant Brown. The U.S. Marshal is authorized to send a request for waiver of service to Defendant Brown in the manner prescribed by Federal Rule of Civil Procedure 4(d) before attempting personal service. Plaintiff's motion for attorney representation #3 is denied without prejudice. Plaintiff's motion for an extension of time #9 is denied as unnecessary. December 29, 2020 Opinion or Order Filing 7 ORDER: Plaintiff Kinton Jones, a prisoner at Menard Correction Center, brings this action pro se under 42 U.S.C. 1983. Before the Court is Plaintiff's complaint for screening as required by 28 U.S.C. 1915A. While Plaintiff has paid the filing fee, summonses shall not issue, because Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim pursuant to 28 U.S.C. 1915A. If Plaintiff wishes to pursue this litigation, by January 26, 2021, Plaintiff must submit: (1) an amended complaint; and (2) a separate completed USM-285 service form for each Defendant named in the amended complaint. Failure to submit those items by that date will result in dismissal of this case. The Clerk is directed to send a copy of this order to Plaintiff, along with an amended civil rights complaint form and a blank USM-285 (Marshals Service) form.
