October 12, 2021 Filing 26 STATUS Report Joint Status Report by Mireya Dondalski (White, Chaundre)
September 27, 2021 Filing 25 MINUTE entry before the Honorable Heather K. McShain: The Court has reviewed the parties' joint status report #24 . The parties report that document discovery has been completed. As to oral discovery, due to scheduling conflicts related to recent Jewish holidays, the parties have agreed to schedule two remaining depositions (Drs. Paula Grabler and Lisa Stempel) for shortly after the 09/30/2021 fact discovery deadline #7 , on 10/06/2021 and 10/15/2021. While the parties expect these two Rule 30(b)(6) depositions to obviate the need for any additional depositions, Plaintiff states that she may seek a short extension of the fact discovery deadline, if necessary. Plaintiff notes that any such depositions "would be few in number and short in duration," while Defendant notes that it does not agree that any such extension should be granted (if sought). Despite the parties' failure to file a timely motion to extend the fact discovery deadline as previously instructed by the Court #23 , the fact discovery deadline is extended to 10/15/2021 for the limited purpose of completing the Grabler and Stempel depositions based upon the agreement of the parties and for good cause shown due to the scheduling issues discussed above. Joint status report due 10/18/2021 to update the Court on: (a) the state of settlement discussions (if any), including whether the parties believe that a settlement conference with the Court would be productive; and (b) any other matters the parties wish to raise with the Court prior. Should Plaintiff seek a further extension of the fact discovery deadline to take additional depositions, Plaintiff must file a timely motion for extension supported by good cause. The parties are directed to contact Chambers via email (at Chambers_McShain@ilnd.uscourts.gov) at any time should they be interested in discussing settlement. Mailed notice. (pk, )
September 27, 2021 Filing 24 STATUS Report Joint Status Report by Mireya Dondalski (White, Chaundre)
August 23, 2021 Filing 23 MINUTE entry before the Honorable Heather K. McShain: The Court has reviewed the parties' joint status report #22 . The parties report that Rush is in the process of identifying its corporate representative(s) to be deposed. Plaintiff "hopes, given the scope of the 30(b)(6) topics, that percipient fact witness depositions can be greatly truncated if not rendered unnecessary." The parties are reminded of the 09/30/2021 fact discovery deadline set by Judge Feinerman on 01/15/2021 #7 , and are encouraged to work together to complete any outstanding depositions by that time. The parties are again reminded that, notwithstanding any preference to take depositions in person, they cannot expect this in the current environment, nor can they reasonably expect the case to be put on hold until that changes. To be more specific, the parties are to assume that all depositions will have to be taken by remote means (except where specifically agreed otherwise by the parties and the witness) and are to plan accordingly. Delay due to a desire to take in-person depositions at a later date will not be a basis for extending the 09/30/2021 fact discovery deadline. Joint status report due 09/27/2021 to update the Court on: (a) the status of depositions and whether any fact discovery remains outstanding; (b) the state of settlement discussions (if any), including whether the parties believe that a settlement conference with the Court would be productive; and (c) any other matters the parties wish to raise with the Court prior to the 09/30/2021 fact discovery deadline. Should the parties anticipate being unable to complete all remaining fact discovery by that time, they must file a timely motion for extension supported by good cause. The parties are directed to contact Chambers via email (at Chambers_McShain@ilnd.uscourts.gov) at any time should they be interested in discussing settlement. Mailed notice. (pk, )

McShain: The Court has reviewed the parties' joint status report #20 , in which the parties report that Plaintiff is in the process of reviewing Defendant's document production and anticipates issuing notices of depositions within the next two weeks. Further joint status report due 08/20/2021 to update the Court on: (a) the status of discovery, including a deposition plan for any depositions that remain outstanding; (b) the state of settlement discussions, if any; and (c) any other matters the parties wish to raise with the Court. The parties are reminded that, notwithstanding any preference to take depositions in person, they cannot expect this in the current environment, nor can they reasonably expect the case to be put on hold until that changes. To be more specific, the parties are to assume that all depositions will have to be taken by remote means (except where specifically agreed otherwise by the parties and the witness) and are to plan accordingly. Delay due to a desire to take in-person depositions at a later date will not be a basis for extending the 09/30/2021 fact discovery deadline #7 . The parties are directed to contact Chambers via email (at Chambers_McShain@ilnd.uscourts.gov) at any time should they be interested in discussing settlement. Mailed notice. (pk, )
