Filing 8 ORDER: The plaintiff's application to proceed in forma pauperis #4 is denied without prejudice. If the plaintiff wishes to proceed with her claims, she must pay the required filing fee within 21 days. Plaintiff's motion for attorney representation #5 is also denied without prejudice. In considering motions for appointed counsel, the court examines whether the plaintiff has made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, given the difficulty of the case, whether the plaintiff appears competent to litigate the case themselves. See Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007). Here, there is no indication that the plaintiff has made an attempt to secure counsel before enlisting the Court's assistance. Any subsequent motion for appointed counsel should describe Plaintiff's efforts to retain counsel, and if those efforts prove unsuccessful, should address "whether the difficulty of the casefactually and legallyexceeds the particular plaintiff's capacity as a layperson to coherently present it." Pruitt, 503 F.3d at 655. Plaintiff is encouraged to contact the District's Pro-Se Help Desk at 312-435-5691. Signed by the Honorable John J. Tharp, Jr on 12/15/2020.Mailed notice (nsf, ) |
