| Filing 8 MINUTE entry before the Honorable Edmond E. Chang: The Plaintiff has filed a motion #5 to voluntarily dismiss the case. The motion is not necessary: under Federal Rule of Civil Procedure 41(a)(1)(A)(i), the Plaintiff may file "a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment," and the dismissal need not be approved by a court order. Nor is an offer of costs required under the Federal Rules of Civil Procedure; in the notice of removal, the defense mentions that it is required under the Illinois Rules of Civil Procedure. As far as the Court can tell, R. 1-1 (Group Exhibit 1), the defense has not filed an answer or a summary judgment motion. (The appearance of the counsel of the Plaintiff was misdocketed in part as an "Answer to Complaint," R. 6, but it plainly is not.) So the motion is denied as unnecessary.
