ORDER The plaintiff's motions for leave to proceed in forma pauperis #6 and for attorney representation #7 are denied without prejudice. In his application to proceed in forma pauperis, Mr. Jones fails to indicate his marital status, though his complaint refers to his spouse. Information on his marital status and spousal employment is necessary to evaluate whether he has access to resources to pay the filing fee. The plaintiff's request for attorney representation is also premature. Plaintiff has not indicated that he has unsuccessfully sought counsel on his own, or provided an explanation for why he is unable to proceed competently without counsel at this stage of the case. He also has not provided relevant information, including his highest level of education. The Court sees no basis to conclude that Plaintiff cannot proceed pro se at this fact-based pleading stage, and encourages Mr. Cabrera to take advantage of the pro se assistance desk as the litigation progresses. The plaintiff may refile a completed application to proceed in forma pauperis by February 19, 2021 or pay the filing fee. If he fails to do one or the other, the case will be dismissed.
