Filing 5 ORDER: Plaintiff's complaint #1 may proceed consistent with this order. The Court directs the Clerk of Court to: (1) file the complaint; (2) issue summonses for service of the complaint on Defendants Rabideau, Brown, and Pork by the U.S. Marshal; and (3) send Plaintiff three blank USM-285 forms, a magistrate judge consent form, filing instructions, and a copy of this order. Plaintiff must complete and return USM-285 forms for service on each Defendant. Failure to return completed USM-285 forms by April 19, 2021, may result in dismissal of the unserved Defendants, as well as dismissal of this case in its entirety. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. If Plaintiff fails to keep the Court informed of his address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Filing 3 MINUTE entry before the Honorable John Z. Lee: Plaintiff initiated this action under 42 U.S.C. 1983, but he has not paid the filing fee or applied for leave to proceed in forma pauperis. If Plaintiff wants to proceed to initial screening under 28 U.S.C. 1915A, he has until January 29, 2021, to either (1) submit an application to proceed in forma pauperis on the enclosed form, along with a copy of his trust fund account statement showing all transactions to his account for the twelve-month period immediately preceding his initiation of this action (from December 24, 2019, to December 24, 2020); or (2) pre-pay the $402 filing fee. Failure to comply with this order will result in summary dismissal of this case.
