April 19, 2021 Opinion or Order Filing 41 MEMORANDUM Opinion and Order: Plaintiff has not met its burden of persuasion for a preliminary injunction. This Court declines to interfere with defendant's business decisions at this juncture and require defendant to re-open bids, rush through a solicitation process that generally takes months, wreak havoc on the City's already precarious budget for 2021, and potentially disrupt critical fuel supply for even one day. A motion for preliminary injunction is currently pending before the Court. The Court set aside a full date for a hearing, reviewed hundreds of pages of exhibits and gave the parties ample opportunity to orally present their case on March 22, slightly over a week ago. At that hearing, the Court assured parties it would issue a ruling shortly. One week after the hearing and before giving the Court an opportunity to rule on plaintiff's motion for preliminary injunction, defendant filed the motion to dismiss. Parties shall use the redline function of Word so the Court can review changes to the standard Northern District of Illinois protective order if the parties choose to use the standard order. By 3/4/21, parties shall file a joint status report advising the Court as to the status of discovery for the preliminary injunction hearing. February 16, 2021 Filing 21 MINUTE entry before the Honorable M. David Weisman: Magistrate status hearing held. Parties appeared telephonically and reported on the status of expedited discovery as it relates to the upcoming Preliminary Injunction hearing. Parties advised the Court that they have met and conferred and were able resolve most issues, but two issues remain. First, the City objects to Plaintiff's First Set of Discovery Requests, Interrogatory No. 4, Request for Production #3, and Request for Admission No. 24 (requests related to Amit Gauri and Black Dog). (Dkt. 15-1 at 2, 4, 6.) The Court heard oral argument on these issues. Following argument, the Court finds that these Interrogatories and the RFA are relevant based on the allegations in Plaintiff's complaint and for purposes of the Preliminary Injunction hearing. Over the City's objection, the City shall answer these Interrogatories and RFA as follows: the timeframe shall be limited to January 2019 thru the date the contract at issue was awarded; the parties advised the Court that they will work towards an agreement as to the scope of the search, including the number of custodians and how the parties intend to conduct relevant searches. The parties shall also meet and confer regarding any affidavits required as to the limited discovery process. Second, the City objects to Plaintiff's First Set of Discovery Requests, Request for Admission Nos. 35 38. (Dkt. 15-1 at 8.) Following oral argument, and without objection, Plaintiff has advised the Court that it will withdraw these RFAs. Plaintiff is given leave to serve 4 contention interrogatories to address those issues originally contained in the four RFA's that have been withdrawn. A telephonic status hearing is set for 2/18/21 at 2:30 p.m. The conference call-in number is 1-877-411-9748 and the passcode is 1814539.
