ORDER: The United States removed this case under 28 U.S.C. 1442(a) and 2679(d), in light of the substitution of the United States under the Federal Tort Claims Act for the claim against Chief Judge Pallmeyer, in her official capacity. The Plaintiff has voluntarily dismissed the claim against the United States, R. 6, pursuant to Civil Rule 41(a)(1)(A)(i). The claim is dismissed without prejudice (but if the Plaintiff purports to add the claim again, then the government shall have the right to file another notice of removal). In light of that dismissal, and because the removal was premised solely on the presence of the federal defendant, the Plaintiff's motion to remand #7 is granted. (After the Plaintiff serves the other Defendants, it might be possible for them to remove the case on another jurisdictional basis.) In any event, the motion #4 to dismiss is terminated as moot.
