February 9, 2021 Filing 7 MINUTE entry before the Honorable John F. Kness: On 1/25/2021, the Court issued a minute order #6 directing Plaintiff to file a jurisdictional statement concerning Plaintiff's standing to sue. The order directed Plaintiff to file the statement on or before 2/8/2021, but as of the date of this order, Plaintiff has not submitted the required statement. Accordingly, Plaintiff is directed to show cause, on or before 2/17/2021, why this case should not be dismissed for lack of jurisdiction, failure to prosecute, or failure to comply with the Court's order. See, e.g., Ball v. City of Chicago, 2 F.3d 752, 760 (7th Cir. 1993) ("There is no 'grace period' before dismissal for failure to prosecute is permissible and no requirement of graduated sanctions, but there must be an explicit warning before the case is dismissed"); Bolt v. January 25, 2021 Filing 6 MINUTE entry before the Honorable John F. Kness: The Court has reviewed the Complaint in this case, which alleges violations of the Fair Debt Collection Practices Act. Dkt. 1. Plaintiff alleges that Defendant NCB Management Services, Inc. obtained the right to collect on a debt related to Plaintiff's car loan. Id. para 6-7. Plaintiff also alleges that Defendant failed to "notate" on Plaintiff's credit reports that Plaintiff disputed that debt and that this allegedly unlawful conduct was "was unfair and unconscionable because it created a false and damaging portrayal of Plaintiff's credit history." Id. paras. 12-14, 25. The Court, however, has questions about whether Plaintiff has adequately alleged that he suffered an injury in fact and thus has standing to sue under the Seventh Circuit's recent case law. For example, the Seventh Circuit addressed the issue of standing under the FDCPA in at least six recent opinions. See, e.g., Nettles v. Midland Funding LLC, 983 F.3d 896 (7th Cir. 2020) (addressing standing under the FDCPA); Bazile v. Fin. Sys. of Green Bay, Inc., 983 F.3d 274 (7th Cir. 2020) (same); Spuhler v. State Collection Service, Inc., 983 F.3d 282 (7th Cir. 2020) (same); Brunett v. Convergent Outsourcing, Inc., 982 F.3d 1067 (7th Cir. 2020) (same); Gunn v. Thrasher, Buschmann & Voelkel, PC, 982 F.3d 1069 (7th Cir. 2020) (same); Larkin v. Fin. Sys. of Green Bay, Inc., 982 F.3d 1060 (7th Cir. 2020) (same). Plaintiff's allegations that Defendant's conduct created a "false representation of Plaintiff's credit wothiness [sic]" and a "damaging portrayal" of his credit history are bare and non-descript. Compl. paras. 23, 25. It is not clear from these allegations whether Plaintiff "suffered--or faced a real risk of suffering--concrete harm." Casillas v. Madison Ave. Assocs., Inc., 926 F.3d 329, 333 (7th Cir. 2019). Accordingly, the Court must conduct a jurisdictional inquiry to address whether Plaintiff suffered a real-world injury in fact. By February 8, 2021, Plaintiff must file a statement that addresses in detail whether he has standing to sue under Seventh Circuit case law. A failure to comply may lead to dismissal.
