March 9, 2021 Opinion or Order Filing 28 MINUTE entry before the Honorable Edmond E. Chang: The agreed motion #27 to set briefing schedule is granted, although the Court modifies the briefing format: rather than four separate defense briefs presenting overlapping arguments, and then four separate response briefs, plus four replies, the Defendants shall coordinate their briefing as follows. The Defendants shall file one combined brief in support of the motion to dismiss, presenting common arguments together and, to the extent necessary (it will be), individualized subsections within the one brief. The Plaintiff shall file one response brief addressing all the arguments. The Defendants shall file one combined reply brief. It is true that there are claims that will be targeted only by one or a subset of Defendants (because not all Defendants are named in all counts) and there also are claims that will certainly require individualized subsections to respond to individualized allegations. On balance, however, it is better to remove the redundancies than it is to receive 12 briefs. For now, the Court adopts the proposed briefing schedule, but given the change in format, the parties may confer and file an extension motion (and also include a request for extra pages). For now, the Defendants will file the combined brief by 05/05/2021. The Plaintiff shall respond by 06/21/2021. The Defendants will file the combined reply by 07/13/2021. The briefing schedule obviates the need for an initial joint status report, but if any party wishes to ask for more information on the issue flagged in R. 6, then the request for information is due by the prior status-report deadline of 04/15/2021. The tracking status hearing of 04/23/2021 is reset to 05/14/2021 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called). On a separate matter, the counsel for Defendant Bonnevier shall file formal attorney appearances on the docket (with pro hac vice applications if needed). Lastly, the Court does strongly encourage the parties to engage in early settlement negotiations before launching into the briefing schedule. The risk, delay, and expense of litigation are all magnified in a case of this kind. And the magistrate judge assigned to the case is an expert at bringing parties together at all stages of a case.
