Filing 35 MINUTE entry before the Honorable John Z. Lee: The Court's 3/18/21 minute order is amended to state that Defendants' motion for an extension #31 is granted. Defendants' response to Plaintiff's motion for reconsideration #28 is due by 4/7/21. Plaintiff's reply, if any, is due by 4/14/21. SUMMONS Issued as to Defendant Robert Baumgardner. (lxk, ) |
Filing 34 MINUTE entry before the Honorable John Z. Lee: Defendant C.D. Peacock, Inc., filed a motion #31 asking for 2 additional weeks to respond to Plaintiff's motion for reconsideration. Plaintiff's counsel says she tried to "compromise" by offering a two-day extension. #32 But, given that Plaintiff originally noticed its motion for reconsideration for presentation on 4/5/21, Plaintiff's counsel's stated belief that "it is in her best interest to preserve the possibility of a ruling on the Motion for Reconsideration prior to the hearing in the State court case" (which is 4/2/21) seems disingenuous, at best. The Court expects more from the attorneys who practice in the Northern District of Illinois. The Court recognizes that the parties have starkly different views of the facts and legal issues in this case. But the attorneys can zealously represent the interests of their respective clients, while simultaneously extending to one another some basic degree of professional courtesy. And, certainly, it is not an efficient use of this Court's resources to decide an disagreement about such a minor, nonsubstantive issue as a reasonable request for a 2 week extension. It is the hope of the Court that it will not have to resolve a dispute of this nature again. Plaintiff's motion #31 is granted. Mailed notice (np, ) |
