March 31, 2021 Opinion or Order Filing 10 ORDER: Petitioner's motion to supplement his 28 U.S.C. 2241 petition #7 is denied. The supplement #8 , which includes information about recent status hearings in his state criminal case, confirms that Petitioner seeks dismissal of his criminal case. As explained in the Court's prior order, Petitioner can raise this claim, along with other constitutional claims, in a 28 U.S.C. 2254 petition if he is convicted. See United States v. MacDonald, 435 U.S. 850, 861 (1978); Winn v. Cook, 945 F.3d 1253, 1260-63 (10th Cir. 2019). To the extent Petitioner's current pleadings can be construed as a challenge of the Court's March 8, 2021 dismissal order, Petitioner has shown neither a manifest error of law nor newly discovered evidence warranting Fed. R. Civ. P. 59(e) relief. See Cincinnati Life Ins. Co. v. Beyrer, 722 F.3d 939, 954 (7th Cir. 2013); Obriecht v. Raemisch, 517 F.3d 489, 494 (7th Cir. 2008). This case remains closed.
