Fuentes: Plaintiff's motion to compel discovery responses ("Motion"; doc. #40 ) is denied without prejudice for failure to comply with Local Rule 37.2. The rule requires an in-person or telephonic conference, and not just an exchange of email, or a statement as to how such a conference could not occur, through no fault of the movant. Further, the required certification under the rule includes (if the in-person or telephonic consultation occurred), the date, time and place of such conference, along with the names of all parties participating therein. LR 37.2. The motion refers to a "call[]" that plaintiff's counsel placed to defense counsel "to confer on the outstanding responses" but does not indicate that an actual conversation took place. Motion at 4. Instead, the Motion attaches an email (Motion, Exh. 4) that refers to a "voicemail" that defense counsel received from plaintiff's counsel. Plaintiff's reply in support of the motion made clearer that the "call" was no more than a voicemail message. Reply in Support of Motion to Compel ("Reply"; doc. #46 ) at 2. So no telephonic or in-person conversation took place at all, and the Motion sets forth no reason why it could not; instead, plaintiff's counsel relied on a voicemail and some email exchanges to satisfy the Local Rule 37.2 meeting requirement, and that is not sufficient. More concerning, though, was defendants' response to the Motion, stating that the discovery dispute raised in the motion "could have been and should be resolved with a two-minute telephone conversation between counsel," that defendants produced documents without objections to the Rule 34 requests, and that in their production, "Defendants turned over all responsive documents." Defendants' Opposition to the Motion to Compel ("Opp"; doc. #44 ). Plaintiff's reply claims that defendants have not produced any documents they did not produce earlier and have not produced documents in response to all of plaintiff's Rule 34 requests, and that plaintiff has yet to receive a written set of responses and objections to the Rule 34 request. Reply at 2. The Court agrees with plaintiff that if in fact defendants have not provided a written set of responses and objections, making clear whether documents are being withheld and if so why, defendants should provide those responses and objections forthwith, and no motion to compel should be needed to make sure defendants do so. Defendants of course may do so now, and perhaps they will, before this Court orders it, but the state of Local Rule 37.2 compliance is not nearly advanced enough to warrant the Court ruling on the Motion. Local Rule 37.2 ultimately rests on what Justice Holmes called the shortness of life and the reality that there is a never-ending procession of cases that compete for judicial attention. If the parties can resolve their issue, the Court's time is saved and available to be directed to those cases that present issues that cannot be amicably resolved. Each hour needlessly spent on a dispute is an hour squandered. See Chicago Observer, Inc. v. City of Chicago, 929 F.2d 325, 329 (7th Cir.1991) ("Litigation is costly not only for the litigants but also for parties in other cases waiting in the queue for judicial attention.") The Court did squander about an hour on this Motion and wishes that it will not have to do so again. Accordingly, the Court implores the parties to confer meaningfully and in compliance with the Local Rule in an effort to resolve a discovery dispute that may well already be resolved without judicial intervention. A joint written status report on the anticipated close of discovery, or any need (as perceived by the parties) for a further extension, is due and to be filed by noon on 10/22/21. Mailed notice.
