April 5, 2021 Filing 7 MINUTE entry before the Honorable John J. Tharp, Jr:The Court finds that Mr. Wei is unable to pay the filing fee, but his complaint is dismissed pursuant to 28 U.S.C. 1915(e)(2)(B). As has been explained to the plaintiff twice by judges in this District, plaintiffs suing for discrimination must first file a charge with the EEOC or IDHR. See Wei v. Department of Physics at the University of Chicago, 17-cv-09138, April 26, 2018 Order, ECF No. 5 (N.D. Ill. 2018); Wei v. Department of Physics and Astronomy at Northwestern University, 18-cv-00008, January 10, 2018 Order, ECF No. 7 (N.D. Ill. 2018). And as in previous suits filed by Mr. Wei, he admits that he has not filed a charge with either the EEOC or the IDHR. Moreover, the Court finds that Wei is precluded from bringing this claim because an almost identical one was dismissed in Wei v. Department of Physics at the University of Chicago, 17-cv-09138. This suit is barred by the doctrine of res judicata. See Coleman v. Labor and Industry Review Commission of Wisconsin, 860 F.3d 461, 469 (7th Cir. 2017) ("screening dismissals have res judicata effect."). A previous suit involving the same claims between the same parties was dismissed pursuant to 1915(e)(2)(B). That Wei made some additions to his application for employment at the University of Chicago in 2020 (including a recommendation letter that he wrote for himself) does not make this a new claim. See Keller v. Monroe County Sheriff's Dept., 473 Fed. Appx. 510, 511 (holding that suit was barred by res judicata after first was dismissed pursuant to 1915(e)(2)(B), even though plaintiff "accuse[d] the Sheriff's Department of committing new crimes since his first suit was dismissed."). The complaint is accordingly dismissed with prejudice and this case is terminated. Mailed notice (air, )
