Guzman: The Court has reviewed Plaintiff's supplemental jurisdictional statements and concludes that it has subject-matter jurisdiction over the case. In lieu of an initial status hearing, the Court directs the parties to, no more than 21 days from the date of this order, confer to discuss the nature and bases of their claims and defenses and the possibilities for a prompt settlement or resolution of the case. The parties shall also discuss deadlines for Rule 26(a)(1) disclosures and a proposed discovery plan. A written initial status report and proposed discovery plan shall be filed no more than 7 days after the parties have conferred. Plaintiff is responsible for initiating such a meeting, and all lead counsel for all parties are required to participate. Failure or refusal to participate in such a meeting or to cooperate in the preparation of the written report may constitute a basis for sanctions. The Court will thereafter issue an order setting a discovery schedule. Mailed notice. (kp, ) |

Filing 3 MINUTE entry before the Honorable Ronald A. Guzman: Plaintiff invokes diversity jurisdiction as the basis for this Court's subject-matter jurisdiction over the instant case. Plaintiff alleges that "[o]n information and belief, at all times relevant hereto, all members of [defendant] Mosaic Springhill[, LLC] were citizens of the State of Illinois and none were citizens of the State of Ohio." However, "Plaintiff must specifically and affirmatively identify the citizenship of every pertinent person and entity; it is not sufficient to assert jurisdiction based on information and belief nor is it sufficient to negatively aver that the person or entity is not a citizen of" a particular state. Pharmerica Corp. v. Crestwood Care, LLC, No. 13 C 1422, 2015 WL 1006683, at *3 (N.D. Ill. Mar. 2, 2015). "As to a limited liability corporation or partnership, the citizenship of each member or partner must be individually and specifically set forth." Id. Plaintiff is directed to file a supplemental jurisdictional statement no later than April 15, 2021. If no supplement is filed, or if the supplement does not properly allege diversity jurisdiction, the case will be dismissed for lack of subject-matter jurisdiction. Mailed notice. (kp, ) |
