MINUTE entry before the Honorable Mary M. Rowland: Plaintiff is directed to further clarify, in an additional supplement to be filed by 6/18/2021, the following jurisdictional information. First, Plaintiff must identify the principal place of business of The Oneida Group, Inc., a Defendant. The fact that this Defendant "conduct[s] a significant amount of business in the States of Ohio and Illinois," (Dkt. 10) does not conclude this inquiry. The phrase "'principal place of business' refers to the place where the corporation's high level officers direct, control, and coordinate the corporation's activities" or the "nerve center" which can "typically be found at a corporation's headquarters." Hertz Corp. v. Friend, 559 U.S. 77, 8081 (2010). Second, Plaintiff must properly allege the citizenship of Defendant Crown Brands LLC dba Oneida Hospitality Group. Plaintiff has alleged its citizenship as if it were a corporation, but it appears to be an LLC. An LLC takes the citizenship of each of its members. Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2007). Thus "an LLC's jurisdictional statement must identify the citizenship of each of its members as of the date the complaint or notice of removal was filed, and, if those members have members, the citizenship of those members as well." Rowland: In light of Plaintiff's invocation of diversity jurisdiction as the basis for federal jurisdiction, on or before 5/14/2021 Plaintiff shall file a jurisdictional supplement as a separate docket entry. Plaintiff is reminded that with respect to individual Defendants, allegations of residence as opposed to citizenship are not sufficient to establish diversity jurisdiction. Slottke v. Wis. Dep't of Workforce Dev., 734 F. App'x 354, 355 (7th Cir. 2018). For individuals, "[c]itizenship means domicile (the person's long-term plan for a state of habitation) rather than just current residence." Myrick v. WellPoint, Inc., 764 F.3d 662, 664 (7th Cir. 2014). Plaintiff is also remined that "a corporation is a citizen of two states (though they may coincide): the state in which the corporation is incorporated and the state in which its principal place of business is located." Pastor v. State Farm Mut. Auto. Ins. Co., 487 F.3d 1042, 1047 (7th Cir. 2007).
