ORDER: Petitioner's application to proceed in forma pauperis (IFP) #3 is denied. His prison trust fund account ledger shows that he has received an average monthly deposit of $237.50 during the six months just prior to filing of his 28 U.S.C. 2254 petition. Even without considering his $1,200 stimulus check received in December 2020, he received an average monthly deposit of $37.50. His receipt of those funds disqualify him from pauper status, and he must therefore pay the $5.00 filing fee in order to proceed with this case. See Longbehn v. United States, 169 F.3d 1082, 1083-84 (7th Cir. 1999); Hill v. Cook, 2021 WL 1178209, at *2 (D. Conn. Mar. 29, 2021) (holding that stimulus checks should be considered when determining a prisoner's ability to pay). By 7/25/2021, Petitioner must pay the $5.00 filing fee, which he may do by check or money order made payable to Clerk, United States District Court Northern District of Illinois. His failure to comply will result in summary dismissal of this case without prejudice. See N.D. Ill. L.R. 3.3(f).
