ORDER: For the reasons stated below, Plaintiff's motion to proceed in forma pauperis #4 is granted. The U.S. Marshals Service is appointed to serve a copy of the summons and complaint on Defendants Gonzalez and Hunt. Plaintiff may not proceed against the Metra Police Department at this time because a police department is not a suable entity, nor is a claim against Metra itself likely to be viable because under Section 1983, a governmental entity "cannot be held liable solely because it employs a tortfeasor." See Beck v. City of Chicago, 2020 WL 7353405, at *7 (N.D. Ill. Dec. 15, 2020) (citing Monell v. Dep't of Soc. Servs. Of City of N.Y., 436 U.S. 658, 691 (1978)). Plaintiff is directed to complete and return the USM-285 forms that will assist the Marshals Service in effectuating service no later than July 9, 2021. Failure to complete those forms will delay the case and may result in sanctions up to and including dismissal of the case for failure to prosecute.
