Filing 11 MINUTE entry before the Honorable John Robert Blakey: The Plaintiff's allegations in the current complaint fail to state a claim upon which relief may be granted. To the extent Plaintiffs seeks to assert state law claims such as libel and slander against Defendants, he must do so in state court, as the parties are not diverse and this Court thus lacks subject matter jurisdiction over these claims. Additionally, to the extent Plaintiff seeks to bring a claim for loss of property or unreasonable seizure of property, he lacks standing to do so as alleged because the property in question, according to the complaint, belongs to someone else. Accordingly, the Court dismisses Plaintiff's complaint without prejudice. If Plaintiff thinks he can amend his complaint, consistent with his obligations under Rule 11, to state a federal claim, he may file an amended complaint by 6/10/21. If Plaintiff fails to amend by this date, the Court will summarily dismiss this case. The Court denies Plaintiff's motions for service #5 and for attorney representation #6 . Plaintiff paid the filing fee in this case and has not demonstrated indigence; as a result, this Court lacks a basis to grant the requested relief. Mailed notice (sxw) |
