Although she is a college graduate and apparently has some post-graduate experience, R. 11 at 2, on review of her response, R. 14, to the dismissal motion, R. 13, the motion for attorney representation is granted. The Court will recruit an attorney to represent the Plaintiff pro bono; the attorney will be identified in a separate docket entry. What follows is simply a warning that the Court issues in every attorney-recruitment case; it is not personal to the Plaintiff. The Plaintiff is alerted that, like any other client who has retained an attorney, she must respect the time and effort of her counsel, and must carefully consider all of the advice provided by counsel. Counsel is under no obligation to pursue claims that do not have a reasonable basis in law or in fact. May 24, 2021 Opinion or Order Filing 9 MINUTE entry before the Honorable Edmond E. Chang: The Plaintiff's motion #5 for attorney representation is denied without prejudice. First, the motion is not signed, R. 5 at 2, so any renewed motion must be signed by the Plaintiff. Second, the Plaintiff did not fill out the section on level of education. In deciding whether to recruit a counsel for a plaintiff, education level goes to the ultimate question of whether the plaintiff is competent to litigate on her own, so that answer must be provided. Lastly, and most importantly, the Plaintiff must be financially indigent before counsel would be recruited. Pruitt v. Mote, 503 F.3d 647, 656-59 (7th Cir. 2007) (en banc). So the Plaintiff must complete an in forma pauperis affidavit for purposes of the attorney-recruitment motion (the form is available on the District Court's website). It also is worth noting that the case is in its early stages, so attorney representation might not be needed yet. On the motion #7 to serve summons, again the Plaintiff must be financially indigent in order to appoint the Marshals Service to serve summons with no pre-payment, so the in forma pauperis affidavit will be considered for that purpose too. Having said that, a defense counsel did filed an appearance on 05/17/2021, so it might be that the defense will waive service of process. The Plaintiff shall email or contact the defense counsel to ask. Erin M.
