June 17, 2021 Filing 6 MINUTE entry before the Honorable Joan B. Gottschall: The self-represented plaintiff, Gene Willingham, checked boxes on pages 2 and 3 of his complaint (No. #1 ) indicating that he would be filing his charge of discrimination and Equal Employment Opportunity Commission right to sue letter within 14 days. Because the court needs to see the charge of discrimination and right to sue letter to screen Mr. Willingham's complaint, the court entered minutes (No. #5 ) on 5/21/2021. The minutes were mailed to Mr. Willingham's mailing address and to his email address: genewillingham534@gmail.com. The minutes entered 5/21/2021 gave Mr. Willingham until 6/11/2021 to file either a status report or the charge of discrimination and right to sue letter. The minutes also advised Mr. Willingham that the court operates a helpdesk for people without lawyers and told him how to make an appointment. The deadline of 6/11/2021 has come and gone, and nothing has been filed. Plaintiff is directed to file either a status report or the charge of discrimination and right to sue letter by and including 6/23/2021. If Mr. Willingham needs more time for any reason, he should file a motion explaining in simple terms why he needs more time and how much time he needs. If Mr. Willingham does not file anything by the deadline of 6/23/2021, his case will be dismissed for failure to prosecute under Rule 41(b) of the Federal Rules of Civil Procedure. May 21, 2021 Filing 5 MINUTE entry before the Honorable Joan B. Gottschall: The self-represented plaintiff, Gene Willingham, has filed a form complaint (No. #1 ) alleging employment discrimination and an application (No. #4 ) to proceed without prepaying the filing fee. Although the application to proceed without prepaying the filing fee is not filled out correctly in every respect, plaintiff states under penalty of perjury that he and his spouse have no present income or assets. Plaintiff's application to proceed without prepayment of fees (No. #4 ) is therefore granted. The court is unable to screen plaintiff's complaint, however, because it is unclear from the complaint whether plaintiff has exhausted his administrative remedies. Plaintiff checked the box next to question 7.1(a) indicating that he filed a charge of discrimination with the Equal Employment Opportunity Commission (EEOC) on May 12, 2021. But in response to question 7.2(b) plaintiff indicates that he received a final agency decision on the same date, May 12, 2021. Plaintiff has also checked boxes on pages two and three of his complaint advising the court that he will file the charge of discrimination and the EEOC's right to sue letter (final agency decision) within 14 days. The court will therefore await the filing of plaintiff's charge of discrimination and right to sue letter before screening plaintiff's complaint. See 28 U.S.C. 1915(e)(2). If plaintiff has not filed the charge of discrimination and right to sue letter by June 11, 2021, he must file a status report on that date. The court advises Mr. Willingham that this court operates a help desk for people who represent themselves. Volunteer attorneys staff the help desk. Due to the COVID-19 pandemic, help desk appointments are being conducted by telephone.
