Mack Trucks, Inc., 310 F.R.D. 382, 386 (N.D. Ill. 2015)). District courts have "considerable discretion in striking" material from a pleading under Federal Rule of Civil Procedure 12(f). Delta Consulting Grp., Inc. v. R. Randle Constr., Inc., 554 F.3d 1133, 1141 (7th Cir. 2009). Although not strictly required by Rule 12(f), "motions to strike are frequently denied when no prejudice could result from the challenged allegations, even though the matter literally is within the category set forth in Rule 12(f)." Anderson v. Bd. of Educ. of City of Chi., 169 F. Supp. 2d 864, 868 (N.D. Ill. 2001) (internal quotation marks omitted); Dimensions Med. Ctr., Ltd. v. Aetna Life Ins. Co., No. 93 C 6244, 1995 WL 103776, at *1 (N.D. Ill. Mar. 6, 1995). "The moving party has the burden of showing that the challenged allegations are so unrelated to plaintiff's claim as to be devoid of merit, unworthy of consideration, and unduly prejudicial." Siegel, 283 F. Supp. 3d at 730 (internal quotation marks omitted). Plaintiff has not carried her burden. The challenged defenses are not unrelated to the case and she does not identify any alleged prejudice caused by them. The motion is therefore denied. (rao, )
