Filing 13 MINUTE entry before the Honorable Gary Feinerman:Motion to stay #9 is denied. Plaintiff's motion #9 and the court's 8/6/2021 dismissal order and judgment #10 #11 #12 essentially crossed in cyberspace. The 7/9/2021 order #8 gave Plaintiff until 7/30/2021 to respond to Defendants' motion to dismiss #7 , and when Plaintiff failed to file a response, the court spent considerable time preparing the dismissal order (with explanatory reasons) and transmitting it for entry on the docket; the court's preparation and completion of the order occurred well before Plaintiff filed his motion. Plaintiff does not explain in his motion why he missed the 7/30/2021 response deadline, and he has no ground to complain that the court prepared and sent for entry the dismissal order a week after he missed that deadline. See Keeton v. Morningstar, Inc., 667 F.3d 877, 884 (7th Cir. 2012) (affirming the district court's denial of a party's motion for leave to make a tardy filing where the court "had already gone through the effort of analyzing the case" and prepared its ruling by the time the tardy filing was submitted). Civil case remains closed.Mailed notice. (jlj, ) |
