Filing 8 MINUTE entry before the Honorable Manish S. Shah: Plaintiff alleges that defendant The Habitat Company manages the Judge Fisher Apartments for the Chicago Housing Authority and its employees (unnamed in this complaint) deprive plaintiff of his right to privacy. Plaintiff alleges that he named the employees in a separate complaint. Plaintiff initiated six separate cases on 7/26/21, including cases that refer to the alleged privacy invasion at his apartment. See 21 CV 3957 (alleging that individual defendants set up the apartment above plaintiff's to allow the occupant to spy on plaintiff); 21 CV 3958 (alleging that the defendant occupied the apartment above plaintiff's and used technology to spy on plaintiff); 21 CV 3959 (alleging that the U.S. government installed equipment to monitor plaintiff); 21 CV 3961 (alleging that the property manager at the Judge Fisher Apartments knew that plaintiff's apartment was below an apartment with spying technology). To properly manage the court's dockets and cases, plaintiff should name all defendants involved in the same transactions or occurrences in one complaint, supervised by a single judge. But in any event, the complaint in this case contains only conclusory allegations which are not enough to state a plausible claim for relief against The Habitat Company (which is likely only liable under Section 1983 if it had a policy or widespread practice that caused a violation of plaintiff's constitutional rights). The complaint in this case is too vague to suggest liability. The complaint is dismissed without prejudice to plaintiff bringing a claim in one of his earlier filed cases (arising out of the same transaction or occurrence as alleged here). The application to proceed in forma pauperis #4 and motion for attorney representation #5 are terminated as moot. This case is closed. Terminate civil case. Notices mailed. (psm, ) |
