Filing 5 ORDER: Petitioner John Colasurdo, a Pontiac Correctional Center inmate, seeks to bring a second 28 U.S.C. 2254 to challenge his life sentence under Miller v. Alabama, 567 U.S. 460 (2012) (addressing the constitutionality of a mandatory life sentence for a defendant who was a juvenile when he committed his offense). To bring a second or successive 2254 petition, the petitioner must "move in the appropriate court of appeals for an order authorizing the district court to consider the application." 28 U.SC. 2244(b)(3). None of Petitioner's filings indicate he has obtained permission from the Seventh Circuit to file his current 2254 petition. Additionally, his life sentence was imposed in Kankakee County in the Central District of Illinois, which is also where he is in custody and where he filed his first 2254 petition. See Colasurdo v. Pierce, No. 11 C 2083 (C.D. Ill.). Venue for his 2254 petition is thus in the Central District. See 28 U.S.C. 2241(d). Accordingly, this case is dismissed without prejudice to Petitioner seeking permission from the Seventh Circuit to file a second 2254 petition, and to him refiling his petition in Illinois' Central District.
