Dow, Jr: The court has reviewed the status reports [28, 29, 32] filed since yesterday's status hearing reporting that the parties were unable to reach agreement on preserving the status quo and adjusting the terms of the now-expired TRO by agreement to accommodate both sides' interests. As noted on the record, other lawyers and parties have been able to reach accord on this issue see KTM v. The Individuals, Case No. 21-cv-1279, docket entries 77 and 79 (N.D. Ill. 2021). It appears to be true based on the authority cited by Plaintiff in today's submissions that the Court can extend a TRO beyond the 28-day limit in the rules without agreement of the Defendant, but the effect of the extension is to convert a TRO into an immediately appealable preliminary injunction. Had counsel been able to provide that authority yesterday, the Court may have granted the requested relief. But when asked, Plaintiff did not have the authority available, nor did it submit the authority prior to the expiration of the TRO at 5pm yesterday. Given that the TRO has expired, the Court is in no position to extend it. Indeed, the current request [see 28, 29] appears to be to decide the preliminary injunction motion #18 expeditiously. That motion, of course, became fully briefed only yesterday. As the Court explained at yesterday's status hearing, it is in the middle of a lengthy trial. The motion for preliminary injunction remains under advisement and will be ruled on in due course. The Court will attempt to expedite consideration of it, but there are many competing demands on the Court's attention and there is no guarantee on when a decision will be issued.
